Doctoral dissertation: Pluralist Arguments and Institutional Justification.

The point of departure may be expressed through the following research question: What are the conditions of possibility for the diffusion of substantive (i.e. value-laden) reasoning across legal orders?

A first section has the aim of mapping through the diversity and complexity of contemporary theories of pluralism in practical reason. Its outcome is meant to shed light on the normative claims of pluralist arguments (regarding values, politics, and law) in contemporary practical philosophy. The following sections have the aim of looking more closely at pluralist arguments as a reflexive challenge for legal reasoning (understood as a special case of general practical reasoning) and legal orders in our globalized and interdependent age. Its outcome is meant to reflect the importance of pluralism creating a productive tension between the claim of authority and public reasonableness which distinguishes law.

I aim to integrate genealogical approaches toward value pluralism in modernity (from Max Weber onwards); tensions among the more cognitivist and the more conventionalist premises required for our globalized thought and practice of human rights and substantive moral argumentation; and the bearing of these reflections in sequencing between: (i) a concept of law which recognizes it as both argumentative and authoritative; and (ii) taking contemporary law and normative orders beyond the state seriously.
